These terms and conditions outline the rules and regulations for the use of Voltebyk's website (voltebyk.com) and for all purchases made through it. By accessing this website and/or placing an order, you accept these terms and conditions in full. Do not continue to use voltebyk.com if you do not agree to all of the terms and conditions stated on this page.

Performance Disclaimer

Product performance including speed, range, and rideability depends on multiple external factors such as rider weight, terrain, incline, riding habits, and maintenance. Voltebyk does not guarantee uniform performance under all conditions.

📋 Definitions

"Client", "You", "Your" and "Customer" refers to the person accessing this website and placing orders.

"The Company", "Ourselves", "We", "Our", "Us" and "Voltebyk" refers to VOLT E BYK, Tirupati, Andhra Pradesh.

"Platform" and "Website" refers to www.voltebyk.com and all associated services.

"Product" refers to any electric cycle, conversion kit, spare part, accessory, or component sold through the Platform.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client, in accordance with and subject to prevailing Indian law. All disputes are subject to the exclusive jurisdiction of the courts of Tirupati, Andhra Pradesh.

✅ Acceptance of Terms

By (i) using this Platform or any Services in any way; (ii) merely browsing the Platform; or (iii) placing an order, you agree that you have read, understood and agreed to be bound by these Terms.

The Company retains an unconditional right to modify or amend these Terms without any requirement to notify you. It is your responsibility to check these Terms periodically for changes. Your continued use of the Platform following the posting of changes constitutes your consent and acceptance of those changes.

These Terms are binding under relevant provisions of the Information Technology Act of 2000 and all applicable Indian laws.

🔒 All Sales Are Final

All products sold by Voltebyk, including electric cycles, conversion kits, spare parts, and accessories, are sold on a strictly non-returnable, non-refundable basis. Once an order has been confirmed and payment has been successfully processed, the transaction is considered final and binding.

This means:

  • ❌ No returns will be accepted on any product once it has been sold and dispatched.
  • ❌ Used Products: Returns are strictly NOT accepted once the product has been used, assembled, or operated. Any evidence of usage immediately disqualifies the product for return consideration.
  • ❌ No refunds will be issued under any circumstances after payment has been completed.
  • ❌ No exchanges are available for change of mind, wrong size selection, colour preference, or buyer's remorse.
  • ❌ No chargebacks — Any payment dispute or chargeback initiated after successful delivery without first contacting our support team for resolution may be considered a breach of the accepted purchase agreement.

💳 Payment & Transaction Policy

All payments made to Voltebyk are final and non-reversible. Once a payment is successfully processed through our payment gateway (Razorpay or any other authorized channel), the amount is non-refundable at any cost, regardless of the reason.

  • • Payment confirmation constitutes your agreement to the finality of the transaction.
  • • Partial refunds, store credits, or adjustments are not available.
  • • In the event of a duplicate payment due to technical error, only the duplicate amount will be refunded after verification within 15–30 business days.
  • • Customers are responsible for ensuring the correct product, variant, and quantity before checkout.

🚫 Order Cancellation Policy

Once an order is placed and payment is confirmed, cancellations are not entertained. The payment amount is non-refundable and cannot be refunded at any cost.

  • • Before Dispatch: Even if the product has not yet been dispatched, the payment amount is non-refundable.
  • • After Dispatch: No cancellations are possible once the product has been shipped.
  • • Refusal to Accept Delivery: If a customer refuses to accept delivery, the product will be returned to our facility. No refund will be issued, and the customer will be liable for round-trip shipping charges.

📦 Delivery, Transit & Inspection

The merchant is not liable for any damage, loss, or delay that occurs during transportation. All risk passes to the customer upon dispatch from Voltebyk's facility.

  • 📱 Report any transit damage on the same day of delivery via WhatsApp with clear photos and/or video.
  • ⚡ Claims reported after the delivery day will not be entertained.
  • 🎥 An unboxing video is mandatory to process any transit damage claim.
  • 🔧 Valid claims are resolved through part replacement only — not product returns or refunds.

⚠️ Important: Always record a complete unboxing video from the moment you receive the package. Failure to document damages at the time of delivery will limit our ability to process claims.

🤝 Pre-Delivery Acceptance Clause

By accepting delivery of the product from our logistics partner, the customer expressly confirms that:

  • The product is in complete working condition at the time of delivery.
  • The product specifications and features match the order placed.
  • There are no visible manufacturing defects or external damages.

Any claims made after product usage will be subject to technical inspection only. Acceptance of delivery constitutes your informed consent that the product was delivered as described and in the defined working condition.

🔋 Electric Cycle Range/Mileage Disclaimer

The range/mileage of electric cycles is estimated based on standard testing conditions and should not be considered a guarantee under all riding conditions. Actual range can vary significantly due to:

  • • Rider Weight: Rated range assumes approximately 45 kg rider weight. Higher weight reduces mileage.
  • • Road & Terrain: Rough surfaces, gravel, sand, and inclines require more energy, reducing range.
  • • Weather: Extreme cold/heat and strong headwinds affect battery efficiency.
  • • Battery Health: Range naturally diminishes over time with repeated charging cycles.
  • • Riding Style: Faster speeds and aggressive acceleration drain the battery faster.
  • • Maintenance: Underinflated tyres, worn brakes, and unlubricated chains increase energy consumption.

Range variations due to any of the above factors are not considered product defects and are not covered under warranty or eligible for returns/refunds.

🛡️ Limitation of Liability & Warranty Disclaimer

Voltebyk's liability is strictly limited to the repair or replacement of defective parts under warranty.

Voltebyk shall NOT be liable for:

  • Indirect, incidental, special, or consequential damages.
  • Loss of use, inconvenience, or personal discomfort arising from product use or service delays.
  • Any claim for compensation, mental harassment, or emotional distress.
  • Any amount exceeding the actual purchase price of the specific product paid by the customer.

THE WEBSITE AND ASSOCIATED MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, VOLTEBYK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL VOLTEBYK OR ANY OF ITS AGENTS, VENDORS OR SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF THE USE, MISUSE OF OR INABILITY TO USE THE WEBSITE OR ANY PRODUCT PURCHASED THROUGH THE WEBSITE.

⚖️ Dispute Resolution Process & Class Action Waiver

In the event of any dispute, Voltebyk encourages amicable resolution through direct communication with our support team. However:

  • • All disputes shall be governed by the laws of India.
  • • Exclusive jurisdiction lies with the courts of Tirupati, Andhra Pradesh.
  • • Mandatory Pre-Dispute Resolution: Before initiating any formal legal action, you agree to first contact Voltebyk support (support@voltebyk.com or +91 8074081940) and attempt to resolve the dispute amicably within 30 business days. Written evidence of this attempt is required before any legal proceedings.
  • • Chargeback Protection: Any payment dispute or chargeback initiated after successful delivery without first contacting our support team for resolution may be considered a breach of the accepted purchase agreement.
  • • Voltebyk reserves the right to update, modify, or amend these terms at any time without prior notice.
  • • Any cause of action arising from the use of this website must be commenced within one (1) month after the claim arises.

🛡️ Indemnification

You agree to defend, indemnify and hold harmless Voltebyk, its directors, officers, employees, agents, vendors, suppliers, and affiliates from and against any and all claims, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to your use or misuse of any Product, your violation of these terms, or any claim made by a third party arising from your use of the Product.

This indemnification obligation survives the termination of these terms and any purchase transaction.

🌪️ Force Majeure

Voltebyk shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond Voltebyk's reasonable control, including but not limited to:

  • • Acts of God, natural disasters, earthquakes, floods, storms, or epidemics/pandemics
  • • War, terrorism, civil unrest, riots, or government sanctions
  • • Supply chain disruptions, raw material shortages, or component unavailability
  • • Internet or telecommunications failures, power outages, or server failures
  • • Delays or failures by shipping carriers, logistics partners, or courier services
  • • Changes in applicable laws, regulations, or government orders

In such events, Voltebyk's obligations shall be suspended for the duration of the force majeure event. No refund, compensation, or penalty shall be applicable.

⚡ Assumption of Risk — Electric Vehicle Usage

By purchasing and using a Voltebyk electric cycle, you voluntarily assume all risks associated with the use of electric-powered vehicles, including but not limited to:

  • • Personal injury, property damage, or death resulting from use, misuse, or accidents
  • • Risks inherent in riding any bicycle or electric vehicle on public or private roads
  • • Battery-related risks including overheating, swelling, or reduced performance over time
  • • Risks from improper charging, use of non-approved chargers, or exposure to extreme temperatures
  • • Risks from failure to wear appropriate safety gear (helmet, reflective clothing, etc.)

Voltebyk is not liable for any injuries, damages, or losses arising from the use of its products.

🧰 DIY Installation, Lithium‑Ion Battery & Fire Hazard Liability Waiver

Customers assume all risks associated with DIY (Do-It-Yourself) installation of electric cycle conversion kits, motors, controllers, and lithium-ion batteries. The Company is strictly not liable for any property damage (including but not limited to house fires or cycle fires), personal injury, or death resulting from improper installation, wiring faults, short circuits, or battery misuse.

Lithium-ion batteries pose inherent fire risks if punctured, overcharged, subjected to incorrect wiring, or misused. Customers assume full responsibility for safe storage, charging, handling, and usage of lithium-ion batteries, and for following the manufacturer's safety instructions and applicable local regulations.

Professional installation by a qualified technician is highly recommended. Any DIY installation, modification, or repair is performed entirely at the customer's own risk and may void applicable warranties. By proceeding with DIY installation, you agree that Voltebyk is released from any liability for damage, injury, or loss arising from such activities.

✍️ Consumer Acknowledgment & Informed Consent

By completing a purchase on voltebyk.com, you expressly acknowledge and agree that:

  • • You have had sufficient opportunity to read and understand these Terms before making a purchase.
  • • You were not coerced, pressured, or rushed into making the purchase.
  • • You understand that all sales are final, non-returnable, and non-refundable and accept this willingly.
  • • You have verified all product specifications, compatibility, and features before placing the order.
  • • You understand the inherent risks associated with electric vehicles and accept them.
  • • These Terms are fair and reasonable in light of the factory-direct pricing, warranty coverage, and customer support provided by Voltebyk.

This acknowledgment constitutes an express waiver of any future claim that you were unaware of, did not understand, or did not consent to any term stated on this page.

🏛️ Governing Law & Legal Framework

These Terms shall be governed by and construed in accordance with the laws of India, specifically:

  • • Indian Contract Act, 1872 — governing the validity and enforceability of these Terms
  • • Information Technology Act, 2000 — governing electronic transactions and communications
  • • Sale of Goods Act, 1930 — as applicable to product transactions
  • • Consumer Protection Act, 2019 — to the extent applicable, noting full pre-purchase disclosure
  • • Arbitration and Conciliation Act, 1996 — governing dispute resolution

The courts of Tirupati, Andhra Pradesh, India shall have exclusive jurisdiction.
